CORONER’S LEGAL POWERS | make this report under paragraph 7, Schedule 5, of the Coroners and Justice Act 2009 and regulations 28 and 29 of the Coroners (Investigations) Regulations 2013. INVESTIGATION and INQUEST On 15" August 2014 | commenced an investigation into the death of Thomas lan Hunt, age 19 years. The investigation concluded at the end of the inquest on 8" January 2015. The conclusion of the inquest was Accident. [4 CIRCUMSTANCES OF THE DEATH On the morning of 10th August 2014 the weather was extremely wet. At about 10.30am a Volkswagen Lupo driven by Thomas Hunt came into collision with a-Renault Clio driven »y Thomas was driving his vehicle in a northerly direction along the B1192 when he lost control of his vehicle on a compound left bend in the village of Brothertoft, colliding with the Renault Clio which was iin its own lane of the carriage way. Both vehicles were travelling at similar speeds at the time of the collision. The sub-optimal condition of the road surface contributed to Thomas's loss of control. Although resuscitation attempts continued for some time after Thomas was extricated from his vehicle, it is likely that he died shortly after the collision. In my opinion there is a risk that future deaths will occur unless action is taken. In the circumstances it is my statutory duty to report to you. The MATTERS OF CONCERN are as follows. — ‘ 1 During the inquest evidence was presented describing how there have been a number of non-injury collisions at the scene of the collision where Thomas died. These would not have been recorded on the local authority's database. The nationgspeed limit of 6(0mph applies to the B1192 as it passes through Brothertoft village. Evidence was presented to the effect that a 50mph speed limit would be more appropriate given that the B1192, as it passes through Brothertoft, is bordered by residential properties and farm entrances. ACTION SHOULD BE TAKEN In my opinion action should be taken to prevent future deaths and | believe you and/or your organisation have the power to take such action. YOUR RESPONSE You are under a duty to respond to this report within 56 days of the date of this report, namely by 6" March 2015. I, the coroner, may extend the period. Your response must contain details of action taken or proposed to be taken, setting out the timetable for action. Otherwise you must explain why no action is proposed. As required under Section 7 of your report, I make the following response. I can confirm that a section of the B1192, on the bend at Brothertoft, was resurfaced in November 2014. The request to reduce the current speed limit along this section of road will be addressed in accordance with Lincolnshire County Council's Speed Limit Policy. As part of our Speed Management Review in Lincolnshire, we are currently in the process of reviewing our existing Speed Limit Policy. The revised new Policy is due to be considered by the Council's Highways and Transport Scrutiny Committee on 9 March 2015. Subject to the outcome at this meeting, we will proceed to the public consultation on the revised new Policy. It is anticipated that any new revised Policy will be formally adopted by the Council in the Autumn. An assessment for reducing the current speed limit along this section of the road will be actioned once the outcome of the current review has been completed and any revised new Policy is adopted by the Council. In the meantime, we intend to commence the investigation and assessment process to determine whether this site meets the current policy criteria. I trust that the above response is satisfactory.
