REGULATION 28 REPORT TO PREVENT FUTURE DEATHS THIS REPORT IS BEING SENT TO: Tyersal Farm Tyersai Lane Pudsey Leeds 1 i CORONER | am Kevin McLoughlin, Assistant Coroner, for the coroner area of West Yorkshire (Eastern) 2 7 CORONER’S LEGAL POWERS | make this report under paragraph 7, Schedule 5, of the Coroners and Justice Act 2009 and regulations 28 and 29 of the Coroners (Investigations) Regulations 2013. 3 | INVESTIGATION and INQUEST On 23" May 2013 | commenced an Investigation into the death of Craig Marren aged 42 years. The investigation concluded at the end of the Inquest on 25" February 2014. The conclusion of the Inquest was Accidental Death including medical cause of death ia) Chest and neck injuries. 4 r CIRCUMSTANCES OF THE DEATH On Saturday 18" May 2013 Craig Marren was riding an off-road motorcycle on an un- adopted road known as Tyersal Lane, Bradford when he was in collision with a motorcar being driven in the opposite direction. 5 | CORONER’S CONCERNS During the course of the Inquest the evidence revealed matters giving rise to concern. In my opinion there is a risk that future deaths will occur unless action is taken. In the circumstances it is my statutory duty to report to you as | understand that you are the owner of the land adjacent to Tyersal Lane at the point of impact. | enclose two photographs illustrating the scene as one approaches a left hand bend with limited visibility around the bend. The MATTERS OF CONCERN are as follows. — My concern is that this is effectively a blind left hand bend for any vehicles approaching in the direction shown in the photographs. The trees and/or foliage at this point impedes the sight line for any vehicle travelling around the bend. ACTION SHOULD BE TAKEN In my opinion the action which should be taken to prevent future deaths is to cut back the trees and/or foliage at the bend in order to improve visibility for vehicles negotiating the bend. | believe that as the owner of the land you have the power to take such action. YOUR RESPONSE You are under a statutory duty to respond to this report within 56 days of the date of this report, namely by 12" May 20714. I, the Coroner, may extend this period if you request me to do so. Your response must contain details of action taken or proposed to be taken, setting out the timetable for action. Otherwise you must explain why no action is proposed. i COPIES and PUBLICATION | have sent a copy of my report to the Chief Coroner and to the following interested Persons: family of Mr Craig Marren, tam also under a duty to send the Chief Coroner a copy of your response. The Chief Coroner may publish either or both in a complete or redacted or summary form. He may send a copy of this report to any person who he believes may find it useful or of interest. I can confirm that the Highway Authority does have powers under the Highways Act (1980) s130. | have raised an order for the hedge to be flailed back sufficient to clear the highway of obstruction.
