ANNEX A REGULATION 28: REPORT TO PREVENT FUTURE DEATHS (1) NOTE: This form is to be used after an inquest. REGULATION 28 REPORT TO PREVENT FUTURE DEATHS THIS REPORT IS BEING SENT TO: 1. The Highways Department, Salford City Council, Civic Centre, Chorley Road, Swinton, Salford, M27 5FJ 1 CORONER I am Professor Dr Alan Peter Walsh, HM Area Coroner for the Coroner Area of Manchester West 2 CORONER'S LEGAL POWERS I make this report under paragraph 7, Schedule 5, of the Coroners and Justice Act 2009 and Regulations 28 and 29 of the Coroners (Investigations) Regulations 2013. 3 INVESTIGATION and INQUEST On the 12th of July 2021 I commenced an investigation into the deaths of Michael John Draper, 62 years, born the 23rd of May 1959 and Rafal Wojdyl, 43 years, born the 23rd of March 1978. The investigation concluded at the end of the inquest on the 9t h of February 2022. The medical cause of death of Michael John Draper was: 1 a) Multiple Injuries The medical cause of death of Rafal Wojdyl was : 1 a) Severe Head and Chest Traumatic Injuries The conclusion of the investigation in relation to both deceased was Road Traffic Collision. 4 CIRCUMSTANCES OF THE DEA TH 1) Michael John Draper and Rafal Wojdyl died in a road traffic collision which occurred on the 23rd of June 2021 on Cadishead 2) Way, lrlam at its junction of Fairhills Road, lrlam. Mr Draper was driving a Dacia Logan vehicle and Mr Wojdyl was sat in the rear seat of the vehicle directly behind Mr Draper. The vehicle was being driven along Fairhills Road towards the junction with Cadishead Way, lrlam. 2) At the same time, a Heavy Goods Vehicle was being driven northbound along Cadishead Way towards Manchester and a Citroen Berlingo was travelling in the opposite direction along Cadishead Way intending to turn right into Fairhills Road, lrlam. 3) At the junction Mr Draper, without reason, pulled out of Fairhills Road into Cadishead Way directly into the path of the Heavy Goods Vehicle and there was a collision and as the collision developed Mr Draper's vehicle was pushed back by the Heavy Goods vehicle causing a further collision between Mr Draper's vehicle and the Citroen Berlingo. 4) Both deceased sustained injuries in the collision and they were taken to the Salford Royal Hospital, where they later died from their injuries. 5) The junction of Cadishead Way with Fairhills Road, lrlam is not controlled by traffic signals and the speed limit on Cadishead Way, lrlam in the area of the junction is 50mph. 5 CORONER'S CONCERNS During the course of the inquest the evidence revealed matters giving rise to concern. In my opinion there is a risk that future deaths could occur unless action is taken. In the circumstances it is my statutory duty to report to you. The MATTERS OF CONCERN are as follows. 1) During the Inquest evidence was heard that:- a) The junction is very busy allowing access to industrial and retail units, including Tesco, Lidl and Screwfix off Fairhills Road, lrlam. b) Cadishead Way, lrlam is a very busy designated 'A' road, namely the A57 road, which is an access road towards Manchester in one direction and the M6 motorway in the other direction. c) At the junction there is no footpath on one side of Cadishead Way and approaching the junction with Fairhills Road from the direction of the M6 motorway there is a bend, a bridge, trees and bushes, all of which obscure and affect the line of vision of vehicles exiting Fairhills Road into Cadishead Way, lrlam. I d) The junction of Fairhills Road with Cadishead Way, lrlam is very busy with vehicles turning into both Fairhills Road and Cadishead Way from both directions, which could cause distractions to drivers, particularly a driver exiting Fairhills Road into Cadishead Way with vehicles travelling at 50mph along Cadishead Way and the restricted view. 2) I request that you conduct a review of the following issues in relation to the junction of Fairhills Road with Cadishead Way, lrlam: a) The layout of the junction of Fairhills Road with Cadishead Way, lrlam. b) The speed limit of 50mph on Cadishead Way in the area of the junction with Fairhills Road, lrlam. c) The restricted views of vehicles pulling out of Fairhills Road into Cadishead Way, lrlam, particularly caused by trees, bushes and undergrowth. d) The provision of traffic signals at the junction of Fairhills Road with Cadishead Way, lrlam. 6 ACTION SHOULD BE TAKEN In my opinion action should be taken to prevent future deaths and I believe you have the power to take such action. 7 YOUR RESPONSE You are under a duty to respond to this report within 56 days of the date of this report, namely by 8th July 2022 I, the coroner, may extend the period. Your response must contain details of action taken or proposed to be taken, setting out the timetable for action. Otherwise, you must explain why no action is proposed. 8 COPIES and PUBLICATION I have sent a copy of my report to the Chief Coroner and to the following Interested Persons I , brother of Michael John Draper , brother of Radal Wojdyl 3 I have also sent it to Greater Manchester Police who may find it useful or of interest. I am also under a duty to send a copy of your response to the Chief Coroner and all interested persons who in my opinion should receive it. I may also send a copy of your response to any other person who I believe may find it useful or of interest. The Chief Coroner may publish either or both in a complete or redacted or summary form. He may send a copy of this report to any person who he believes may find it useful or of interest. P. Walsh I am writing to you on behalf of Salford City Council in response to the Regulation 28 Report to prevent future deaths at the junction of A57 Cadishead Way and B5311 Fairhills Road following the fatal road traffic collision involving Mr. Draper and Mr. Wojdyl on the 23rd June 2021. Within the report you have made a request for the Council to conduct a review of four issues relating to the layout, speed limit, restricted view and provision of traffic signals at the junction of Fairhills Road with Cadishead Way. I would like to inform you that Salford City Council’s Collision Investigation Team have carried out a detailed investigation into the junction following the collision. This involved a site visit on the 30th of June 2021 with Greater Manchester Police’s Specialist Operations Roads Policing Unit to understand the circumstances of the collision and to review the operation of the junction. A desktop exercise was also undertaken to review the collision history and traffic survey data in the immediate vicinity of the junction. A technical note has been appended to this letter containing the findings from the Council’s investigation covering the four issues you have identified along with the actions the Council have already undertaken, as well as those actions still to be implemented. I would be grateful for your acknowledgement upon receipt of this letter and appended documents. I would also be open to receiving any further feedback you have in response to the Council’s proposals to prevent a future death occurring at this junction.
