REGULATION 28: REPORT TO PREVENT FUTURE DEATHS (1) NOTE: This form is to be used after an inquest. REGULATION 28 REPORT TO PREVENT FUTURE DEATHS THIS REPORT IS BEING SENT TO: 1. Birmingham City Council Highways department 2. West Midlands Police Road Traffic Division 1 CORONER I am Louise Hunt, Senior Coroner, for the coroner area of Birmingham and Solihull 2 CORONER’S LEGAL POWERS I make this report under paragraph 7, Schedule 5, of the Coroners and Justice Act 2009 and regulations 28 and 29 of the Coroners (Investigations) Regulations 2013. 3 INVESTIGATION and INQUEST On 11 November 2013 I commenced an investigation into the death of Saleh Ali Dalie. The investigation concluded at the end of the inquest on 4th March 2014. The conclusion of the inquest was road traffic collision. 4 CIRCUMSTANCES OF THE DEATH The deceased came out of his house on Kyotts Lake Road and went to cross the road to attend his local mosque. He entered the road between parked cars and was he was hit by a van. He was taken to the Queen Elizabeth Hospital where he later died from his injuries. 5 CORONER’S CONCERNS During the course of the inquest the evidence revealed matters giving rise to concern. In my opinion there is a risk that future deaths will occur unless action is taken. In the circumstances it is my statutory duty to report to you. The MATTERS OF CONCERN are as follows. – (1) There have been several incidents and 2 fatalities on this road. Residents have campaigned for road calming measures and parking restrictions and appropriate crossing measures which have not been introduced. I am concerned about the safety of this road given it is a residential area. 6 ACTION SHOULD BE TAKEN In my opinion action should be taken to prevent future deaths and I believe your organisation have the power to take such action. 7 YOUR RESPONSE You are under a duty to respond to this report within 56 days of the date of this report, namely by 6th May 2014. I, the coroner, may extend the period. Your response must contain details of action taken or proposed to be taken, setting out 1 the timetable for action. Otherwise you must explain why no action is proposed. 8 COPIES and PUBLICATION I have sent a copy of my report to the Chief Coroner and to the following Interested Persons Mr Dalie’s family. I am also under a duty to send the Chief Coroner a copy of your response. The Chief Coroner may publish either or both in a complete or redacted or summary form. He may send a copy of this report to any person who he believes may find it useful or of interest. You may make representations to me, the coroner, at the time of your response, about the release or the publication of your response by the Chief Coroner. 9 11th March 2014 2

| refer to your letter and Regulation 28 Report dated 11 March 2014 concerning the above.
Over the years, we have worked closely with your office and the West Midlands Police to follow the
outcome of inquests and carry out improvements to public highway In order to reduce the potential
for the reoccurrence of serious road collisions,
Birmingham City Council regrets any loss of life on the City's roads and Is working towards
reducing road accident casualties across the City through education, engineering, enforcement and
highway improvement programme of works every year.
The City Council's Local Safety Scheme Programme team monitors all reported Injury accident
casualties and the locations with adverse accident records are then selected for detailed
assessments and potential highway Improvement proposals to reduce the likelihood of a
reoccurrence of Injury accidents. These proposals are prioritised and form the basis of the Local
Safety Scheme Capital Programme for the following year.
| can confirm that this site has been identified through our monitoring system and that initial
investigations are being undertaken. The provision of temporary vehicle activated speed signs has
been agreed and these will be installed early In the next financial year. These will collect speed
data and warn motorists that they are exceeding the speed limit.
There Is a meeting arranged for later this month with local residents and the Police to ascertain
local concerns and to consider further actlons, should they be necessary. Any further actions will
be dependent on an assessment of whether the works proposed are likely to be effective In
reducing the accident pattern Identified, whether the proposals are affordable and on a successful
public consultation.

To summarise, and to meet the requirements of our formal response to your report;
Birmingham City Council will take action and install Vehicle Activated Speed Signs on
Kyotts Lake Road. This work Is already being planned and it Is anticlpated that the works
will be complete by the end of July 2014.
The City Council will consider further works as part of the Local Safety Scheme element of
its Capital Programme for 2014/15. Any works carried out as part of that programme will
be completed by March 2015.
